Terms of Service

These Terms of Service ("Terms") govern your access to and use of SitePeek, a service operated by DinoDigest LLC ("SitePeek", "we", "us", "our"). By using SitePeek or by authorizing SitePeek to act on your behalf (including managing your Google Business Profile), you agree to these Terms and to our Privacy Policy.

1. The Service

SitePeek provides:

• Website service: automatically generated websites for local businesses, hosting, SSL, and ongoing updates (the "Website Service").
• Google Business Profile service (when enabled): auditing, optimizing, posting to, replying on, and reporting on your Google Business Profile under the permissions you grant (the "GBP Service").
• Free previews: auto-generated website previews built from publicly available business information, sent to business owners as part of our outreach.

We may add, change, or remove features at any time. We will not materially reduce paid features without notice.

2. Accounts & Eligibility

To use paid features you must be at least 18 years old, have legal authority to bind your business, and provide accurate information. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us promptly at hello@sitepeek.co if you suspect unauthorized access.

3. Your Authorization for Actions on Your Behalf

By signing up and connecting external accounts, you authorize SitePeek to act on your behalf in the ways you specifically enable through your dashboard settings. This authorization is specific and revocable. We will not perform any action requiring consent without your prior specific and express consent — including, where applicable, replies to reviews, Q&A answers, listing edits, or new listings on your Google Business Profile.

You can change permission settings or revoke any authorization at any time in your dashboard, by removing SitePeek as a manager of your Google Business Profile at business.google.com, or by revoking access at myaccount.google.com/permissions. If you ask, we will disassociate your account from our system within seven (7) business days.

4. Google Business Profile Management

If you enable the GBP Service:

• You represent that you own or are an authorized manager of the Google Business Profile location(s) you connect.
• You grant SitePeek permission to read your profile data and perform the specific actions you enable in your dashboard.
• You are responsible for the accuracy of information about your business that you provide or approve, including hours, services, and contact details.
• Some updates to your Google Business Profile are subject to Google's review, may be modified or rejected by Google, and may take time to appear on Google Search and Maps. We do not control Google's review process or timing.
• We do not control your ranking on Google Search or Google Maps. We will work to improve relevant signals, but rankings depend on Google's algorithms.
• You may remove SitePeek as a manager at any time. Doing so will end the GBP Service for that location.

5. Your Content & Public Business Information

Your content. You retain ownership of content you provide to SitePeek (photos, text, business information). You grant SitePeek a non-exclusive, worldwide license to host, display, modify, and distribute that content as necessary to provide the Service.

Public business information. SitePeek builds previews using business information that is publicly available (for example, on Google Maps). If you are the owner of a business and would like your information removed from a SitePeek preview, contact hello@sitepeek.co and we will remove it promptly.

Your website. While your subscription is active, SitePeek hosts and operates your website. If your subscription ends, your website is taken offline at the end of your paid period. Your business content remains yours, and we will provide a reasonable export of your content on request within 90 days of cancellation.

6. AI-Generated Content

Parts of the Service use AI to draft website copy, review replies, posts, and other content. AI-generated content may contain errors, inaccuracies, or content that does not reflect your views. You are responsible for reviewing and approving content before it is published, except where you have explicitly enabled auto-publish for a specific category. You can disable any auto-publish setting at any time.

7. Fees, Billing & Cancellation

• Subscription. Paid plans are billed monthly in advance. Setup fees are charged once at activation. Prices are listed on our Pricing page and may be updated with at least 30 days' notice for existing subscribers.
• Payment. Payments are processed by Stripe. By providing payment information you authorize us and Stripe to charge the applicable fees.
• Trials. If you receive a free trial, you may cancel at any time before the trial ends to avoid charges. Setup fees are disclosed before any trial begins.
• Cancellation. You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current paid period; we do not prorate partial months.
• 90-day call-volume refund. If you do not experience a measurable increase in inbound call volume on the SitePeek-tracked phone number assigned to your account during the first 90 days following Service activation, you may request a full refund of all fees paid to that point, including any one-time setup fee. "Measurable increase" is defined as a higher inbound call count during the final 30 days of the 90-day window compared to the baseline established in the first 30 days; SitePeek will provide the call-volume report on request. Refund requests must be submitted within 14 days after the end of the 90-day window via your dashboard, by replying to any SitePeek SMS, or by email to support@sitepeek.co. Approved refunds are processed within 5 business days to the original payment method. This guarantee covers your first paid subscription term only; it does not apply to renewals or to accounts that have been reinstated after a prior cancellation.
• Other refunds. Outside the 90-day performance-refund window described above, fees already paid are non-refundable except where required by law. Cancelling your subscription stops future billing but does not retroactively refund prior paid periods.
• Failed payments. If a charge fails, we may suspend the Service after reasonable notice and retry attempts.

8. Acceptable Use

You agree not to use SitePeek to:

• Violate any law or regulation, or infringe the rights of others
• Misrepresent your business or another business's identity
• Publish content that is fraudulent, deceptive, defamatory, harassing, or illegal
• Send unsolicited commercial messages outside lawful, opted-in channels
• Interfere with, probe, or attempt to gain unauthorized access to SitePeek systems or other users' data
• Use SitePeek to scrape, resell, or republish Google data in violation of Google's terms

We may suspend or terminate accounts that violate these rules.

9. SMS Messaging Program Terms

Program. SitePeek's SMS program sends preview links to local business owners and transactional messages to customers (account, billing, support, and service notifications).

Frequency. Message frequency varies. Outreach previews are limited to 1–2 messages per business. Recurring marketing messages are not sent without explicit consent.

Cost. Standard message and data rates may apply. Contact your wireless carrier for plan details.

Opt-out. Reply STOP to any message to opt out. You will receive one confirmation and no further messages.

Help. Reply HELP to any message or contact hello@sitepeek.co.

No sharing. SMS opt-in data and phone numbers are not shared with third parties or affiliates for marketing or promotional purposes.

10. Third-Party Services

SitePeek interoperates with third-party services including Google (Maps Platform and Business Profile APIs), Cloudflare, Stripe, Twilio, Anthropic, and OpenAI. Your use of those services through SitePeek is also subject to the providers' own terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Disclaimers & No Guarantees

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Public business information sourced from Google Maps or other directories is accurate
• Specific outcomes will occur, including rankings on Google Search or Maps, traffic, calls, leads, sales, or revenue
• Edits submitted to Google will be accepted or appear on Google within a specific timeframe

12. Limitation of Liability

To the maximum extent permitted by law, in no event will SitePeek or DinoDigest LLC be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the fees you paid to SitePeek in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless SitePeek and DinoDigest LLC from any claims, damages, liabilities, and costs (including reasonable attorneys' fees) arising from (a) content you provide or approve for publication, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third party's rights.

14. Termination

You may cancel at any time. We may suspend or terminate the Service for any account that violates these Terms, fails to pay, or creates a security risk. On termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive termination.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-product notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.
